Was published, where the parents' concern about the supposed indoctrination of the students of this capital company regarding alleged "violent acts produced by inside the school". It supported the information on photographs of an activity where students showed flags from Manuel Rodríguez Patriotic Front (FPMR).
Later, the students and parents clarified that the photographs corresponded to the realization of an academic activity within history.
Following the publication of the journalistic work, the National Television Council (Cntv) received more than 125 complaints, causing a "montage" in the realization of the note. Because of this, the Ombudsman's office filed a complaint of protection for the "student community" of the company and against the television station at the end of October. The agency argued that "the violation of the right of honor to the students" was with the broadcast.
At the same time, the Ombudsman requested removal of audiovisual material from Canal 13 platforms and all measures, including public excuses. "
But yesterday, the Board of Appeal of Santiago rejected the action the company submitted. In his opinion, the second department claimed that there was "lack of active legitimization of the Ombudsman for Children" by assuming the representation of the students. This is because the educational institution's management did not appeal to Channel 13 "suggesting a clear fact: who represents" the school community ", its director, does not feel concerned about what the press releases published on television."
In a fierce sense against the state unit, the appeal court referred directly to the situation that has been living in recent months, Liceo 1 "Javiera Carrera" because of the series of shots and demonstrations held in this place.
"It is striking that the Ombudsman for Children, whose main purpose is to convey, protect and promote children's rights (…) has not encouraged to study and thus prevent mass emigration of young people to other businesses," he points out. error.
Violation of rights
In the text, signed by Ministers Juan Cristóbal Mera and Jenny Book with lawyer Jorge Norambuena, the Court questioned the Ombudsman's representativeness to assume the defense of the company's students. He also defended the action from the Channel 13 Press Department when he reported on the subject.
"It has preferred to initiate this action without legitimacy for it and without the agreement of lyceum alone, by the" study community "- without it being clearly known what this term means – towards a media outage that has done nothing but seriously enlightens specific situation, which is in sharp violation of the right to girls in high school referred to, receives an education without violent turbaciones ".
These are "girls who, according to the said protection resource, receive political indoctrination and still one who speaks for political violence," the decision adds.
